Mussa Kaleem v. State,

MLD 2011 1788 · Balochistan High Court

This case is about how prison remission (sentence reduction) should be calculated when a convict's sentence changes on appeal. Mussa Kaleem was convicted under the Control of Narcotic Substances Act and sentenced to 14 years' rigorous imprisonment. While his appeal was pending, the President of Pakistan granted a special remission of one-fourth of the total sentence to mark the passing of the 18th Constitutional Amendment. Later, the High Court reduced Kaleem's sentence from 14 years to 10 years after he chose not to contest his conviction on merits and only sought a lighter sentence. Kaleem argued he should get one-fourth remission based on his original 14-year sentence, since that was his sentence when the President's order was issued. Jail authorities disagreed, calculating the remission based on the reduced 10-year sentence, which meant he had not yet served enough time to be released.

The Balochistan High Court sided with the jail authorities. It explained that under the Pakistan Prison Rules, "sentence" means the sentence as finally fixed after appeal, not the original trial court sentence. Since Kaleem's appeal resulted in a reduced sentence of 10 years, that became his final sentence, and the one-fourth remission had to be calculated on 10 years, not 14. The petition was dismissed.

This case matters because it clarifies how courts and prison authorities should compute remissions when sentences are altered on appeal, ensuring remission calculations follow the final legal sentence rather than the original one.
