Muhammad Din v. the State,
MLD 2011 1764 · Balochistan High Court
This case involved a double murder in Naseerabad district, Balochistan. Muhammad Din was convicted by a Sessions Court and sentenced to death for killing two men, Moula Bakhsh and Sajjan Khan, who were allegedly shot along with companions while returning from shopping. The prosecution's case rested on eyewitness accounts from the complainant and another witness who were relatives of the deceased, supported by medical evidence and recovery of empty cartridges from the crime scene. The trial court's death sentence was sent to the High Court for confirmation, while the accused separately appealed for acquittal.
The Balochistan High Court examined the evidence and found the eyewitness testimony credible and consistent with medical findings, rejecting the defense argument that the witnesses were "planted" and that the crime was unseen. However, the court noted that while the prosecution alleged a motive of "Siyahkari" (an accusation often linked to honor-related disputes), it failed to actually prove this motive with solid evidence, even though it wasn't legally required to establish motive at all. Since the prosecution voluntarily raised this motive but couldn't substantiate it, the court treated this gap as a mitigating factor.
As a result, the court upheld the conviction but reduced the death sentence to life imprisonment on both counts, giving the accused credit for time already served in custody. This case illustrates how failure to prove an alleged motive, even when not strictly necessary for conviction, can still influence sentencing in murder cases.
