Muhammad Ali v State,
MLD 2011 1686 · Balochistan High Court
This case involves an appeal by Muhammad Ali, who was convicted of murdering Abdullah and sentenced to death by the Sessions Judge, Lasbella. The trial court's decision was also sent to the High Court for confirmation as a mandatory murder reference.
According to the prosecution, the victim's widow, Mst. Sher Bano, woke up to find her own brother, the appellant, standing armed after firing shots at her sleeping husband. She was the key eyewitness. Her account was supported by other witnesses who confirmed the injuries on the deceased and corroborated recoveries made by police, including two spent Kalashnikov cartridges, blood-stained earth, and blood-stained clothing from the crime scene.
The appellant denied the charge and presented two defence witnesses to support an alibi, but the Balochistan High Court found their testimony inconsistent and unconvincing, noting it failed to support the accused's own statement on oath.
The High Court upheld the conviction, reasoning that the widow was a natural witness with no reason to falsely implicate her own brother, and that her testimony was reliable and well-corroborated. The court also held that even though no motive was proven, this did not weaken the case, since motive is not essential when strong, trustworthy evidence otherwise establishes guilt. The death sentence was confirmed.
This case matters because it illustrates how Pakistani courts evaluate eyewitness credibility, corroborating evidence, and alibi defences in murder trials, and confirms that absence of motive does not automatically
