Ali Muhammad v. the State,

MLD 2011 1636 · Balochistan High Court

A five- or six-year-old girl went missing from her home in Dera Murad Jamali. Her family searched for days, and eventually her dead body was found hidden in a drain at their own guesthouse, showing she had been murdered with a sharp weapon. Two men, Ali Muhammad alias Baboo and Rasool Bakhsh, were later named as suspects by the girl's father and were tried under the Anti-Terrorism Act and the Pakistan Penal Code. The trial court convicted them, sentencing both to life imprisonment plus fines.

On appeal, the Balochistan High Court overturned the conviction. It found that the prosecution's case rested mainly on police testimony about the accused supposedly confessing and pointing out where a knife was hidden. Confessions made to police are not legally admissible as evidence, and while the recovery of the knife itself could be considered, the knife wasn't even proven to have blood on it, and no forensic report was presented to confirm this. The court stressed that such recovery evidence is only "corroborating" and cannot substitute for real, direct proof of guilt. It also noted that the complainant admitted he suspected the accused only based on their reactions during "Balochi Hal-o-Ehwal," a traditional greeting custom, which is not proof of a crime. Because the case did not meet the standard of proof beyond reasonable doubt, the court gave the accused the benefit of the doubt and acquitted them.
