Saddar-Ud-Din V. Government of Balochistan through Secretary, Communication and Works Department Quetta and another,

MLD 2011 1506 · Balochistan High Court

This case involved Saddar-Ud-Din, a government employee who worked as a Junior Engineer in what became Balochistan's Communication and Works Department. He was implicated in corruption cases (accused of fraudulent drawing and embezzlement of government funds) and arrested. After being released on bail, he developed cancer and was unable to work or claim his salary. The government had ordered a departmental inquiry into the corruption allegations but never completed it, claiming they could not locate him to serve him a show-cause notice. Because of this unresolved situation, his salary was never released to him despite his repeated requests.

The Balochistan Service Tribunal ruled in his favor. It found that the authorities' excuse for not completing the inquiry was weak, since they could have published a notice in newspapers or served him through jail authorities while he was in custody, as required under the Efficiency and Discipline Rules. The Tribunal emphasized that criminal proceedings and departmental proceedings are separate matters, one dealing with criminal liability and the other with service discipline, and failure in one does not excuse inaction in the other. Since the employee remained formally under suspension rather than dismissed, he was entitled to full salary and benefits under Fund
