Muhammad Saleem v. Abdul Samad Khan,
MLD 2011 1475 · Balochistan High Court
This case involved railway employees who filed a contempt of court application against Pakistan Railways officials, claiming they had disobeyed a 1985 Supreme Court order. That earlier Supreme Court ruling had held that certain railway service rules did not prevent the employees from receiving specific financial benefits under a government notification. Railway authorities paid these benefits for years but eventually stopped, prompting the employees to argue this amounted to willful defiance of the Supreme Court's decision, punishable as contempt.
The Balochistan High Court disagreed. It found that the Supreme Court's 1985 order only clarified the employees' rights in general terms and did not issue any specific, enforceable direction ordering the authorities to make payments. Since there was no concrete command to disobey, stopping the payments could at most be seen as a denial of the employees' rights, not contempt of court. The court explained that for a contempt application to succeed, there must be a clear, executable order that was violated, and that condition was not met here.
As a result, the court dismissed the contempt application as legally not maintainable. However, recognizing that the case had been pending since 2004 through no fault of the applicants, the court allowed them 60 days to pursue the correct legal remedy elsewhere, such as filing a proper civil claim for their unpaid dues.
