This case involved a dispute over a National Assembly seat reserved for women from Balochistan, following the 2008 general elections. Dr. Noor Jehan Panezai and Zubaida Jalal were both listed as candidates for the reserved women's seat on the Pakistan Muslim League (Q) party's priority list, with Zubaida Jalal at number one and the petitioner at number two. However, Zubaida Jalal separately contested a general seat as an independent candidate and lost. After the deadline for submitting the official priority list had passed, the party president wrote to the Election Commission asking that Zubaida Jalal's name be removed and that the petitioner be declared the winner instead. The Election Commission rejected this request and declared Zubaida Jalal the returned candidate on the reserved seat, prompting this election petition challenging that decision.
The Balochistan High Court, acting as an Election Tribunal, dismissed the petition. It held that Zubaida Jalal had never resigned from the party, changed loyalty, violated party policy, withdrawn her candidacy, or been disqualified by any court. The party president had no legal authority to alter the priority list after the official deadline. The court also found no legal bar preventing a candidate from simultaneously contesting a general seat and being listed for a reserved seat. Since Zubaida Jalal remained validly at the top of the list on the relevant date, her declaration as the returned candidate stood, and the petition was dismissed.
