This case is about a dispute over a 2008 provincial assembly election in Balochistan (constituency PB-25 Jaffarabad-I). Attaullah Khan Buledi, who lost to Rustam Khan Jamali, filed an election petition alleging rigging, bogus voting, abduction of his polling agents, and intimidation of voters at several polling stations. He asked the tribunal to recount votes, declare the result void, and either declare him the winner or order re-polling.
While the petition was pending, the winning candidate, Rustam Khan Jamali, was killed in Karachi. His side then argued the petition had become pointless and should be dismissed as "abated," with the Election Commission asked to declare the seat vacant and hold a by-election instead.
The Balochistan High Court, sitting as an Election Tribunal, rejected that argument. It held that under the Representation of the People Act, 1976, an election petition does not automatically end just because the returned candidate has died; the tribunal must still proceed to decide the case, if necessary through ex parte proceedings against the deceased respondent's side. The court also noted that under the law, if a contesting candidate dies before polling day, the election is postponed - but that rule did not apply here since the death occurred after the election, not before.
This ruling matters because it clarifies that allegations of electoral fraud must still be examined and resolved even if the winning candidate later dies, rather than letting such deaths be used to sidestep scrutiny of the election's fairness.
