Jamal Shah Khilji v. State,

MLD 2010 730 · Balochistan High Court

This case comes from the Balochistan High Court and concerns a man arrested under Pakistan's narcotics law for alleged possession of drugs. During the police investigation, he asked the investigating officer to record statements from two witnesses he believed would support his case, but the officer refused. He then asked the Judicial Magistrate to order the police to record these statements, but the Magistrate refused too, saying courts cannot direct how police conduct investigations. When he challenged this before the Special Judge through a revision petition, the judge agreed the Magistrate's reasoning was flawed but still dismissed the plea because the trial had already begun and the case had moved to the court stage. The judge instead told him he could present evidence himself during trial.

The petitioner then approached the High Court, arguing the witnesses' statements were crucial and should have been recorded during investigation. The High Court explained that while trial courts have power to summon important witnesses who were missed during investigation, once a trial has actually started, the High Court should not interfere by ordering re-investigation, as this would disrupt the normal trial process. It also clarified that a Sessions Court cannot use its revisional powers to review purely administrative orders passed by a Magistrate. For these reasons, the High Court dismissed the petition.

This ruling matters because it clarifies the boundaries between police investigation, magisterial oversight, and trial court powers, and confirms that courts should generally let ongoing trials proceed rather than send cases back for further investigation.
