The State through Deputy Prosecutor General V. Muhammad Kaleem Bhatti,

MLD 2010 676 · Balochistan High Court

This case involved a corruption conviction under the National Accountability Ordinance. Muhammad Kaleem Bhatti had been convicted and sentenced to five years imprisonment along with a fine of Rs. 1,50,00,000. As part of the sentence, his properties were ordered forfeited to cover the fine amount, but the judgment also specified that if the fine was not recovered or paid, he would serve an additional two years in prison.

Bhatti served his original sentence and, since the fine was not recovered, also served the additional two years in default of payment. He then applied to the trial court asking for his properties to be released, arguing that since he had already served the extra sentence in lieu of paying the fine, the forfeiture no longer applied. The trial court agreed and ordered the release of his properties.

The National Accountability Bureau (NAB) appealed this decision to the Balochistan High Court, arguing the order was illegal and reopened a matter already settled by the Supreme Court.

The High Court dismissed the appeal, holding that once Bhatti served the additional sentence in place of paying the fine, the punishment had been fully carried out. The law does not allow double punishment, so his properties could not remain forfeited once he had served time instead of paying. The court also noted that the trial court, having issued the original judgment, was best placed to interpret its own order.
