Faizullah v. Atta Muhammad,
MLD 2010 1959 · Balochistan High Court
This case involved a long-running dispute over shared agricultural property in Balochistan. An earlier suit between two sets of respondents over the property had been decided by compromise, resulting in a decree. Some individuals who were not part of that suit later claimed they were also shareholders and owners of the same property, and that the decree had been obtained fraudulently and in collusion between the parties, without their knowledge, specifically to deprive them of their rights. They said they only found out about the situation in 2003, when their tenant farmers refused to hand over their share of the produce. They asked the court to set aside the earlier judgments and decrees and to be added as parties so the case could be reheard on its merits.
The trial court and appellate court had already rejected this request, and the applicants brought the matter to the High Court.
The High Court dismissed the application. It found that the applicants were closely related by blood to one set of respondents and shared common households with them, making their claim of genuine ignorance about the ongoing litigation unbelievable. More importantly, the applicants failed to produce any documents proving their ownership or share in the property, could not even name their tenant farmers, and gave no evidence of the extent of their claimed share. Since they failed to establish even a basic case of fraud or misrepresentation, or show any real title to the land, the court held they were not entitled to have the case reopened or sent back for further evidence.
The case highlights that claims of fraud used to reopen final decrees must be backed by concrete evidence, not vague or unsupported assertions.
