Noor Muhammad v. Noor-ud-Din,
MLD 2010 1731 · Balochistan High Court
This case involved a land dispute in Balochistan over water and pathway rights. The plaintiffs claimed that for over 100 years they had used a watercourse and a passage running through land now owned by the defendants, to irrigate their fields and reach their property. When the defendants allegedly began blocking this watercourse and path, the plaintiffs sued for a declaration of their rights and a permanent injunction preventing interference. The trial court ruled in the plaintiffs' favor, and the first appellate court upheld that decision. The defendants then challenged both rulings before the Balochistan High Court.
The High Court found serious flaws in how the lower courts handled the case. The plaintiffs had not proven that the watercourse and passage actually existed as they claimed, especially since these were not recorded in the official land settlement records from 1958. The plaintiffs' own pleadings were also defective, since despite titling the suit for declaration, they never actually asked the court for a formal declaration of their rights. Additionally, the trial court had ignored important legal objections raised by the defendants, such as improper court fees and failure to include necessary parties. The appellate court, despite noticing these problems, still upheld the flawed decision without proper reasoning.
Because both lower courts failed to properly evaluate the evidence and legal issues, the High Court set aside their judgments and dismissed the plaintiffs' suit entirely. The case underscores that claims of long-standing property rights must be backed by solid evidence and proper legal procedure, not just assertions of tradition.
