Haji Muhammad Azam v. The State,

MLD 2010 1696 · Balochistan High Court

This case involved Haji Muhammad Azam, who was convicted by an Anti-Terrorism Court in Khuzdar for possessing explosives and illegal arms. The charges arose after police were attacked by unknown gunmen in Hub, and a subsequent raid on a house linked to the appellant uncovered hand grenades, explosive material, weapons, ammunition, and bomb-making equipment. He was convicted under section 4(b) of the Explosive Substances Act, 1908 and sentenced to seven years rigorous imprisonment, and under section 13(e) of the Pakistan Arms Ordinance, 1965, sentenced to three years with a fine.

On appeal to the Balochistan High Court, his lawyer did not challenge the conviction itself but only asked for a reduction in sentence. The court noted that the law for the explosives offense mandates a minimum sentence of seven years (or life imprisonment), and since the trial court had already given the lowest possible term, no further reduction was legally possible. For the arms offense, the maximum sentence allowed was seven years, but he had only received three years, already a lenient sentence. Given the serious nature of the offenses, the High Court refused to reduce the punishment further and upheld the conviction and sentences.

This case matters because it illustrates how courts apply mandatory minimum sentencing laws strictly, especially in terrorism-related and explosives cases, and shows that appeals seeking leniency alone, without contesting guilt, have limited scope when statutory minimums have already been applied.
