Khair Muhammad v. The State,
MLD 2010 1676 · Balochistan High Court
This case involved a man named Khair Muhammad who was convicted of murder (qatl-e-amd) under Section 302(b) of the Pakistan Penal Code for killing Muhammad Ramzan, his brother-in-law, and was sentenced to life imprisonment plus a fine of Rs. 100,000 payable to the victim's family. The prosecution's case was that the killing stemmed from a dispute over a marriage proposal: the appellant wanted to marry a woman named Rubina, but believed the victim had interfered to prevent the marriage, leading him to threaten and eventually shoot the victim.
On appeal, the convict argued he was falsely implicated due to prior enmity with the complainant's family, that no weapon was recovered from him, that witnesses were unreliable or interested, and that the trial court had unfairly prevented him from presenting certain defense witnesses.
The Balochistan High Court reviewed the evidence, including eyewitness testimony and the circumstances around the alleged motive. It found that although the accused's police disclosure and pointing out of the crime scene carried little evidentiary weight (especially since no weapon was recovered), the eyewitness accounts were consistent and credible, sufficiently establishing his guilt. The court also found no proof that the trial court had wrongly blocked his defense evidence.
Concluding that the trial court had correctly evaluated the evidence and had already shown leniency in sentencing, the High Court dismissed the appeal and upheld the conviction and sentence. The case illustrates how
