Haji Saleh Muhammad v. Abdul Wadood,

MLD 2010 1659 · Balochistan High Court

This case involved a dispute over land in Quetta. The plaintiffs (Haji Saleh Muhammad and another) claimed they had bought a piece of land in 1995, paid the full price, had the land mutated in their names, and taken possession. In 1998 they built a boundary wall, but in 2000 the seller, Abdul Wadood, allegedly demolished it with tractors, causing damage. The plaintiffs sued for an injunction to stop interference with their possession and for damages, but did not ask the court to formally declare their ownership title.

The defendant denied the plaintiffs had valid title or possession, saying he had instead made a separate deal with a third person (Naseem), who he claimed fraudulently arranged the mutation in the plaintiffs' favor without paying him fully. The trial court sided with the plaintiffs and awarded Rs. 100,000 in damages.

On appeal, the Balochistan High Court found that since ownership of the land was seriously disputed and the key middleman, Naseem, never testified, the plaintiffs could not simply seek an injunction and damages without first asking the court to formally declare their legal title. Without such a declaration, an injunction had no basis, and damages could not be awarded either. The court ruled the suit was not properly framed and dismissed it as not maintainable, setting aside the lower court's decision. The case highlights that in property disputes, proving legal title is a necessary first step before seeking injunctions or damages.
