Abdul Qadir v. Sher Muhammad,

MLD 2010 1596 · Balochistan High Court

This case involved a property dispute in Balochistan between two groups of people, the Abdul Qadir side and the Sher Muhammad side, over land in the Nailant Kappar and Kulanchi areas. The plaintiffs (Sher Muhammad and others) had filed a civil suit asking for a declaration of their ownership, a permanent injunction, and correction of revenue records, claiming that the defendants had wrongly gotten the land registered in their own names through collusion with a revenue official.

Before evidence could be recorded, the trial court (Qazi Pasni) threw out the entire suit at a preliminary stage, citing many technical defects: unclear prayer for relief, missing property boundaries, wrong type of suit given that defendants were allegedly in possession, an earlier pending suit over the same land, lack of proper valuation, and failure to include certain parties. On appeal, the Majlis-e-Shoora set aside this dismissal and sent the case back for a full trial on the merits.

The Balochistan High Court, hearing a further revision petition, upheld the appellate court's decision. It ruled that technical defects like unclear property description, undervaluation, or missing parties are not grounds to dismiss a suit outright without giving parties a chance to fix them or without recording evidence. Disputed facts such as who is actually in possession must be decided through evidence, not assumptions. The court emphasized that cases should be decided on their merits rather than technicalities, and dismissed the petition, restoring the order for a full trial.
