Eid Muhammad v. Abdul Wahab,

MLD 2010 1557 · Balochistan High Court

This case, decided by the Balochistan High Court in Quetta, concerned a dispute over possession of a government quarter (house) in Khuzdar's Civil Colony.

The plaintiff, Abdul Wahab, claimed he was the lawful allottee of the quarter based on an official allotment order issued by the D.C.O. Khuzdar in July 2008. When he tried to take possession, the occupants (Eid Muhammad and another) refused to vacate. They argued that the quarter had originally been allotted to one of them, and later reallotted to their brother, Taj Muhammad, who they claimed was in possession and should have been made a party to the case.

Both the trial court and the first appellate court ruled in favor of the plaintiff, ordering possession to be handed over to him. The occupants then filed this revision petition before the High Court, arguing procedural defects and misreading of evidence.

The High Court dismissed the petition. It found that the allotment order in favor of the defendants' brother had actually been officially cancelled, and neither the brother nor the defendants had ever challenged that cancellation. The defendants failed to produce any valid title document proving their right to possession, and could not show that the lower courts had ignored or misread any evidence.

The court held that merely occupying a property, without lawful allotment, does not create a right to retain possession. This case reinforces that formal, uncancelled government allotment orders determine lawful possession, and unchallenged cancellations remain valid and binding.
