Tufail Ahmed v. Joint Estate Officer,

MLD 2010 1477 · Balochistan High Court

This case involved a dispute over a government flat in Quetta's Customs Colony. Tufail Muhammad claimed he was a lawful allottee of the flat, that rent was regularly deducted from his salary, and that the Joint Estate Officer (representing the Federal Government) had no authority over the property since it was never formally handed over to the government's housing pool. When he received a notice in 2003 ordering him to vacate within 24 hours, he filed a civil suit seeking to have the notice declared illegal and to stop his eviction.

Both the trial court and the appellate court ruled against him, finding that he could not produce any actual allotment order proving he was the lawful occupant, while records showed the flat had indeed been placed under the Federal Government's control. The Balochistan High Court, hearing his revision petition, upheld these decisions. It noted that Tufail Muhammad's claim to the flat had already been rejected in earlier litigation up to the Supreme Court, and that he had concealed this fact from the courts. The judge found this showed bad faith, and criticized him for misusing court proceedings to prolong his unauthorized occupation for over ten years.

The court dismissed the petition, finding no legal error in the lower courts' decisions, and directed authorities to recover possession using the proper legal procedure under the 1965 Ordinance. The case illustrates how courts scrutinize claims of government property occupation and penalize litigants who misuse judicial processes to delay lawful eviction.
