Imtiaz Shah v. The State,

MLD 2010 1424 · Balochistan High Court

This case involved Imtiaz Shah, an employee in charge of a Utility Store in Quetta, who was convicted by a Special Anti-Corruption Court of criminal breach of trust, cheating, and corruption for allegedly submitting fake bank deposit slips and causing stock shortages worth several hundred thousand rupees. He was sentenced to six years in prison and a heavy fine. Shah appealed to the Balochistan High Court, arguing he had been falsely implicated after he reported a dacoity (robbery) at the store and refused illegal demands from a regional manager, and that the audit implicating him was conducted while he was already in police custody, without his presence.

The High Court examined the evidence and found serious problems with the prosecution's case. No proper investigation was conducted into the reported dacoity. The stock audit and discovery of allegedly forged deposit slips both occurred while the accused was in police custody, meaning he had no opportunity to be present or respond. No money or stock was ever recovered from him, and the prosecution failed to show the shortages were actually caused by his actions. The court found this raised doubts about the prosecution's good faith and concluded that both the breach of trust and cheating charges were not proven beyond reasonable doubt.

The High Court set aside the conviction, acquitted Shah, and ordered his release. This case highlights the importance of proper investigation and giving the accused a fair opportunity to respond before being convicted on corruption charges.
