Siraj-ud-Din v. Haji Muhammad Zarif,
MLD 2010 1333 · Balochistan High Court
This case involved a fruit supplier, Sirajuddin, who claimed he supplied grapes worth Rs.438,000 to commission agents in Quetta back in 1993 but was never paid. He said the buyers refused payment, gave him forged receipts showing lower rates, and later tore up records. He also claimed he spent years trying to recover the money through community elders, complaints to authorities, and a legal notice, but was unsuccessful due to the defendants' influence. He finally filed a court case in 2004, eleven years after the transaction.
The buyers denied any business dealings with him and argued the suit was hopelessly time-barred, since claims like this must be filed within three years under the Limitation Act, 1908. Both the trial court and the first appellate court agreed and dismissed his suit, finding he could not prove his claim or justify the massive delay.
The Balochistan High Court, hearing his further appeal (revision), upheld these decisions. It found that while Sirajuddin made vague claims about efforts to recover the money, he never gave specific details of what he actually did or why it took him eight years beyond the legal deadline to sue. The court also noted he had made contradictory statements that undermined his own case. Since he could not show valid grounds to excuse the delay, his revision petition was dismissed.
The case highlights how important it is for plaintiffs to file lawsuits within the legally prescribed time limits, and to provide concrete, credible explanations if seeking condonation of delay.
