Muhammad Yaqoob v. Abdul Aziz,
MLD 2010 1316 · Balochistan High Court
This case concerned a dispute over land and the extent to which a court can revisit a final judgment through a "review" application.
Muhammad Yaqoob had sued Abdul Aziz for specific performance of a 1992 sale agreement to transfer property to him. The dispute was not contested, and the trial court (Qazi Kalat) issued a consent decree in 2004 describing the property's boundaries, including its southern boundary as adjoining a water well. Both parties were present when this decree was passed.
Later, Abdul Aziz filed a review application claiming the southern boundary was actually a public lane, the sole passage for the public, and that this had been improperly altered or cut out of the original agreement. The trial court, after physically inspecting the property, accepted this review and changed the boundary description in the decree. An appellate body, the Majlis-e-Shoora, upheld this change. Yaqoob challenged both decisions before the High Court.
The High Court ruled in Yaqoob's favor. It held that a review application has a narrow scope under the Civil Procedure Code, it cannot be used to introduce new evidence, conduct fresh inspections, or make major changes to a decree as if it were a new trial. Since the original decree was made by consent, with the defendant present, he could not later claim alleged alterations in the sale deed to change the boundaries. The court found no cutting existed at the disputed portion of the original agreement, and no public right could be transferred to benefit a private party's personal claim. Both lower orders were set aside, and the review application was rejected.
