Abdul Ghafoor v. The State,

MLD 2010 1237 · Balochistan High Court

This case involved four men, Abdul Ghafoor and three others, who were convicted of house-trespass under the Pakistan Penal Code for allegedly breaking into the house of a man named Lal Bakhsh, beating him, and humiliating him in front of his sons. A magistrate convicted them, sentencing each to 15 days imprisonment and a fine, and a Sessions Judge upheld this on appeal. The men then challenged both decisions before the Balochistan High Court.

The High Court found serious problems with the case. There was an unexplained delay of nearly eleven hours between the alleged incident and the filing of the police report, with no reason given by the complainant. The court also found significant contradictions between the complainant's written report and the testimony given in court, including disputes over whether the accused carried sticks, how the complainant was beaten, and what his rescuing sons actually did or said. Despite claims of being beaten, the complainant and his witness admitted he suffered no injuries. The lower courts had failed to properly examine these inconsistencies, and the appellate court had simply rubber-stamped the trial court's findings without independently assessing the evidence. The High Court also noted evidence of a pre-existing enmity between the parties, including a separate counter-case.

Given these unresolved doubts and the courts' failure to apply the principle that such doubt should benefit the accused, the High Court set aside both judgments and acquitted all four petitioners.
