Manzoor Ahmed v. The State,
MLD 2010 1217 · Balochistan High Court
This case involved two men, Manzoor Ahmed and Taj Muhammad, who were convicted by a Sessions Judge in Lasbela for robbery under sections 392/34 of the Pakistan Penal Code. They were each sentenced to three years' rigorous imprisonment and a fine of Rs. 10,000. The complainant, Gul Hassan, alleged that three men had forcibly entered his home during Friday prayers and stolen gold ornaments, cash, and a mobile phone.
On appeal, the appellants' lawyer did not argue the case on its merits but simply asked for a reduced sentence. However, the Balochistan High Court chose to examine the evidence itself. It found serious problems: the complainant's statements about the incident and recovery of stolen items were contradictory and had changed over time. Key eyewitnesses, including the complainant's wife and family members, were never questioned by police or listed in the charges. Most strikingly, the accused were identified only through a vague process involving tracker dogs, without clear evidence linking the dogs' search to the appellants' homes.
The High Court ruled that these contradictions created reasonable doubt, and under law, that doubt must benefit the accused. Rather than merely reducing the sentence as requested, the court set aside the conviction entirely and acquitted both men. This case highlights how courts can overturn convictions when police investigations are sloppy and evidence is unreliable, even when the defense doesn't strongly contest the facts.
