PLJ 2018 Islamabad 199

MLD 1711), wherein it has been held that: · Not specified

This case concerns a woman, Mst. Shayan Afzal, who had been given the right to divorce her husband under Column 18 of their marriage contract (Nikahnama). She exercised this right in 2013 by sending talaq notices and applied to the Chairman of the Arbitration Council in Islamabad for a certificate confirming the divorce had taken effect. The husband never appeared despite repeated notices, and reconciliation attempts failed. Before the certificate was issued, however, Shayan died in the UK in 2015. Her father then asked the Arbitration Council to issue the divorce certificate in her name, but his application was dismissed. He challenged this dismissal in the Islamabad High Court.

The court ruled in the father's favor. It held that once a wife has been validly delegated the right of divorce, she can exercise it without needing anyone's permission, and the Arbitration Council has no authority to refuse or withhold the certificate once reconciliation fails and 90 days have passed. The court clarified an important legal principle: if the person who pronounced talaq dies before the 90-day period ends, the divorce does not take effect; but if they die after the 90 days have passed, the Council is legally bound to issue the certificate confirming the divorce was effective.

This judgment matters because it clarifies the rights of women who hold delegated divorce power and limits the discretion of Arbitration Councils to delay or deny recognition of valid divorces, reinforcing procedural fairness under the Constitution.
