Legal Status of Sale Deed could not be resolved in Rent Proceedings
· Sindh High Court
This case was about a dispute between a landlord and a tenant over a shop in Karachi. The tenant, Symphony (Pvt.) Ltd., was renting office/shop space that had originally belonged to a company called Print Off Printers and Publishers (Pvt.) Limited. After that company was dissolved, a person named Rab Nawaz sold the property to Fazal Karim through a registered sale deed. Fazal Karim then sought to evict Symphony for non-payment of rent. Symphony argued that the sale to Fazal Karim was fraudulent, since Rab Nawaz allegedly had no authority to sell the dissolved company's property, and claimed the eviction case was premature since the ownership question was already being contested in a separate civil suit.
Both the Rent Controller and the appellate court ruled in favor of the landlord, ordering eviction for default in rent. The Sindh High Court upheld these decisions. It held that questions about fraud or the validity of a registered sale deed cannot be decided in rent eviction proceedings - such disputes must be resolved through a proper civil suit. Since no one else was claiming ownership of the property, and the sale deed remained valid and unchallenged by any rival claimant, the landlord was entitled to collect rent and proceed with eviction. The court found no illegality in the lower courts' concurrent findings and dismissed the tenant's petition.
