Zakir Hussain V. The State,

KLR 2018 Criminal Cases 82 · Balochistan High Court

This case involved Zakir Hussain, who was convicted by a trial court in Quetta and sentenced to four years imprisonment plus a fine for allegedly possessing an unlicensed Kalashnikov rifle and fifteen live cartridges, under the Pakistan Arms Ordinance, 1965. Police had raided a house looking for his brother, Karar Hussain, who was wanted in a separate attempted murder case, and the house itself belonged to the brother. Zakir Hussain was not named or wanted in that case, nor did he own the house. He argued he had been falsely implicated because his brother was absconding.

The Balochistan High Court accepted his appeal and acquitted him, overturning the trial court's conviction. The court found several serious flaws in the prosecution's case: there was no evidence that police ever asked him to produce a license or permit for the weapon, which is necessary before mere possession becomes a crime. More importantly, the police failed to follow Section 103 of the Criminal Procedure Code, which requires searches to be conducted in the presence of independent, disinterested witnesses to prevent false implication. No such witnesses were involved despite their availability.

This judgment matters because it reinforces that procedural safeguards during police searches exist specifically to protect citizens from wrongful implication, and courts must give the accused the benefit of the doubt when these legal requirements are ignored.
