Mrs. Tahira Parveen Baloch V. Chief Justice, High Court of Balochistan, Quetta through Registrar,

KLR 2018 Criminal Cases 74 · Balochistan High Court

This case involved a District and Sessions Judge in Balochistan who was compulsorily retired from service after being found guilty of misconduct. She faced allegations including withdrawing over three lakh rupees in cash without proper procedure after being transferred from one post, complaints of bribery through a court stenographer while posted elsewhere, and allegedly pocketing money collected from a contractor meant for purchasing air conditioners for the court. A departmental inquiry, conducted by a sitting High Court judge, found her guilty on these counts, and the recommendation of major penalty was accepted by the Chief Justice acting as the disciplinary authority, resulting in her compulsory retirement.

She challenged this decision before the Service Tribunal, arguing the punishment was unjustified. The Balochistan High Court, sitting as the tribunal, dismissed her appeal. The court held that judicial officers must be held to a higher standard than ordinary civil servants because their integrity must be beyond doubt to preserve public confidence in the justice system.
