Haji Mullah Noor Ullah V. Secretary Mines And Minerals and 3 others,

KLR 2017 Civil Cases 266 · Balochistan High Court

This case involved a petitioner, Haji Mullah Noor Ullah, who had been granted a Prospecting License for limestone crushing near Quetta. After local residents complained, his No Objection Certificate was suspended, and eventually his license was cancelled by mining authorities. He challenged this cancellation through a constitutional petition, and separately, a related civil suit he had filed for declaration and injunction was rejected by lower courts.

The Balochistan High Court examined the case not just as a licensing dispute, but through the lens of public health and environmental rights. It held that the right to life under Article 9 of the Constitution includes the right to clean, pollution-free air, and citizens can approach the High Court under Article 199 to protect against environmental harm like air pollution. At the same time, the court recognized that the right to conduct business or trade under Article 18 is not absolute and can be reasonably restricted to protect public welfare, especially when an industry poses health risks.

Balancing these rights, the court ruled that stone-crushing businesses could no longer operate within Quetta city limits. It ordered the government to identify safer zones, away from highways, schools, hospitals, and residential areas, for relocating these businesses within set deadlines, ensure pollution control measures, and conduct regular inspections. This judgment is significant because it prioritizes environmental and public health protections over unrestricted business operations, while still allowing affected businesses a path to relocate and continue operating safely.
