Habib Bank Limited Versus Judge Banking Court Lahore
· Not specified
This case involved a dispute between Habib Bank Limited and a customer who had taken an auto lease finance facility to buy a Honda City car. When the customer defaulted on his monthly installments, the bank repossessed the vehicle under a clause in the lease agreement that allowed it to do so. The customer then filed a suit before the Banking Court seeking rendition of accounts and return of the vehicle, claiming he had paid most of the loan and only a small amount remained outstanding.
The Banking Court ordered the bank to return the vehicle to the customer, relying on a letter in which the customer had asked the bank to waive early settlement charges. The bank challenged this order in the Lahore High Court, arguing that the Banking Court had misread the letter, which actually only refused to waive the settlement charges and did not confirm how much the customer had paid or still owed.
The High Court agreed with the bank. It found that the customer's claim about owing only a small amount was not supported by the case record and had not even been raised in his original suit. Since the bank had validly repossessed the vehicle under the lease agreement due to default, the Banking Court's order returning the vehicle was set aside. The case was sent back to the Banking Court to be decided properly and promptly, within one month.
This case highlights how courts scrutinize evidence carefully before overturning a lender's contractual right to repossess property upon default.
