Eligible family members of Government servant can get house alloted on their names

· Islamabad High Court

This case is about a government-owned house in Islamabad that became the subject of a dispute between two claimants. The petitioner had obtained an allotment order for the house and got a court direction to take possession. Later, it emerged that the house had earlier been allotted to a government servant who retired, and his son had applied for the house to be allotted to him under rules that allow eligible family members, such as a spouse or children, living with a retiring government employee to get that same accommodation allotted in their name. The Ministry of Housing and Works later issued a fresh allotment order in favour of the son, cancelling earlier orders including the one favouring the petitioner. The High Court then recalled its earlier judgment and restored the case for fresh hearing. The petitioner challenged this before the Supreme Court.

The Supreme Court examined how the Estate Office allotted government houses generally and found serious problems: allotments were often made on the basis of favoritism or ministerial discretion rather than following the official waiting list system meant to ensure fairness. The Court held that an employee's accrued right under the General Waiting List cannot be arbitrarily overridden by the government, and any relaxation of rules must have recorded, justifiable reasons.

This case matters because it reinforces transparency and rule of law in the allotment of government housing, protecting eligible family members' rights and curbing discretionary, favoritism-based decisions by officials.
