Mohibullah and another V. The State,

cum · Balochistan High Court

This case involved a motorcycle seized by police after its owner, Muhammad Umar, was booked in a criminal case involving alleged use of a firearm and obstruction of law enforcement. He and a co-accused, Mohibullah, were convicted by a magistrate, and the motorcycle was ordered confiscated by the state. Their conviction was upheld on appeal, but the Balochistan High Court later acquitted both men on revision, giving them the benefit of the doubt, though the judgment did not specifically address what should happen to the motorcycle.

The applicant then filed a separate application asking the court to release the motorcycle to him. The State argued he had delayed too long and that acquittal based on benefit of the doubt was not a full or clean acquittal, so he wasn't entitled to get his property back.

The High Court disagreed. It held that once the conviction was overturned and the accused acquitted, the acquittal was unconditional and complete, regardless of it being based on benefit of the doubt. The court noted the motorcycle was never proven to be stolen or actually used in committing the offence. It also clarified that applications for return of property under the Criminal Procedure Code are not subject to any limitation period. Consequently, the court ordered the motorcycle be returned to the applicant, affirming that acquitted persons are entitled to recover property seized from them unless it is proven to be linked to a crime.
