Sadullah V. The State,
cum · Balochistan High Court
This case involved two accused persons facing murder trials in Balochistan whose cases had stalled because key prosecution witnesses could not be located or produced in court. Instead of proceeding to a verdict or dismissing the charges, the trial courts ordered that the proceedings be kept dormant or in abeyance indefinitely, to be revived whenever the missing witnesses became available.
The accused challenged these orders before the Balochistan High Court, arguing that indefinitely suspending a criminal trial violated their right to a fair and speedy trial.
The High Court agreed. It examined Section 249 of the Criminal Procedure Code, which allows magistrates to stop proceedings, and found this provision applies only to magisterial trials, not to trials before Sessions Courts, which are governed by a different chapter of the law that contains no concept of keeping cases dormant or adjourning them indefinitely. The court held that judges cannot invent such powers where the law is silent; any gap in legislation must be filled by Parliament, not by courts. While Sessions Courts can adjourn cases for specific, reasonable periods with recorded reasons, they cannot suspend trials indefinitely.
The High Court set aside the lower courts' orders and sent the cases back for decision according to law based on available evidence, emphasizing that indefinite suspension undermines the constitutional guarantee of a fair and timely trial and prevents cases from ever reaching a real conclusion.
