Ghousia Rice Mills through Proprietor V. National Bank of Pakistan through Manager and 2 others,

CLD 2024 965 · Balochistan High Court

This case from the Balochistan High Court involved Ghousia Rice Mills, which had a cash finance arrangement with the National Bank of Pakistan secured against mortgaged property and pledged stocks of rice and paddy. Two connected disputes arose. First, the mill owner sued the bank and its insurance company, claiming that floods in 2010 had destroyed the pledged stock (which was kept under the bank's control) and sought a court declaration that the insurance company should pay out on the policy. Second, the bank separately sued the mill owner for failing to repay the finance facility it had taken out, worth over fifteen million rupees.

The trial court dismissed the mill owner's suit against the bank and insurer, but ruled in favor of the bank in its recovery suit. The mill owner appealed both decisions together since they stemmed from the same financial relationship.

The High Court upheld both rulings. It found that the insurance policy itself required disputes over loss amounts to go to arbitration, and since the mill owner skipped this step and went straight to court, the suit was barred by law. On the bank's recovery suit, the court found the bank had properly documented everything required, including loan agreements, account statements, and mortgage papers, satisfying legal requirements for such claims. Finding no errors in how the evidence was handled, the High Court dismissed the appeals, reinforcing that contractual arbitration clauses must be followed before approaching courts.
