Muhammad Musa and 2 others V. National Bank of Pakistan through Branch Manager,
CLD 2024 751 · Balochistan High Court
This case involved a bank recovery suit under Pakistan's banking finance laws. National Bank of Pakistan sued Muhammad Musa and two others to recover about 1.4 million rupees on an agricultural loan that had gone unpaid. When the borrower failed to appear in the Banking Court at Quetta, the court proceeded against him ex-parte (without his participation) and eventually decreed the suit in the bank's favor.
The borrower appealed to the Balochistan High Court, arguing he was never properly served with notice of the case and so never got a chance to defend himself, violating his constitutional right to a fair hearing.
The High Court agreed. It examined the trial court's record and found that the reports from the bailiff (court officer) and courier service about serving notice on the borrower were missing or silent on whether service had actually happened. Under the relevant law, the Banking Court is required to ensure proper service through specific methods like bailiff delivery, registered post, courier, or newspaper publication before proceeding against a defendant. Since none of this was properly documented, the court held that the borrower had been "condemned unheard," meaning judgment was passed against him without he ever getting a fair chance to respond.
As a result, the High Court set aside the original judgment and sent the case back to the Banking Court for a fresh trial, directing that the borrower be given the opportunity to file his defense. This case reinforces that courts must strictly verify proper service of notice before deciding a case against an absent party.
