Malik & Company through Proprietor V. Chairman Pakistan Tobacco Board, Peshawar and others,
CLD 2024 491 · Balochistan High Court
This case involved a dispute over a government cess (tax) collection contract. Malik & Company won a bid to collect cess on Rustica Tobacco in Balochistan for 2002, agreeing to pay Rs. 89 lakh to the Pakistan Tobacco Board in installments. A dispute arose when the Board first exempted certain tobacco by-products from the cess, then withdrew that exemption and demanded the contractor pay outstanding installments. The contractor invoked the arbitration clause in the contract instead of paying, seeking relief through arbitration.
After a long legal history involving multiple arbitration awards, court challenges, and a prior High Court order sending the matter back for fresh arbitration, the Chairman of the Pakistan Tobacco Board, acting as sole arbitrator, issued a new award in 2015. Lower courts upheld this award as binding, and the contractor's appeal was dismissed.
The Balochistan High Court examined whether this arbitration award should be overturned. It held that the arbitrator had properly considered the contractor's losses from the exemption issue, and that courts should not substitute their own interpretation for an arbitrator's decision when reasonable people could disagree about it. Since the grounds for setting aside an award are limited, and no clear misconduct or error was shown, the High Court refused to interfere and dismissed the petition.
This case illustrates the limited scope courts have to review arbitration awards, reinforcing that arbitration decisions are generally final unless clear legal grounds for interference exist.
