Messrs Sabir Traders Sole Proprietorship and another V. National Bank of Pakistan through Manager,
CLD 2023 247 · Balochistan High Court
This case involved a dispute between borrowers, Sabir Traders and its owner, and the National Bank of Pakistan over an unpaid loan. The bank had sued the borrowers for recovery of over 73 lakh rupees, and the Banking Court at Dera Allah Yar ruled in the bank's favor, ordering repayment. The borrowers appealed to the Balochistan High Court, arguing they were never properly heard before the decision was made against them and that they only later learned about the case.
However, the High Court found that the appeal itself was filed too late. Under the Financial Institutions (Recovery of Finances) Ordinance, 2001, appeals must be filed within 30 days, but the borrowers filed theirs 12 days after this deadline. They asked the court to excuse the delay under the general Limitation Act, claiming they hadn't known about the judgment, but the court found this claim false, since records showed they had received a certified copy of the judgment well within the appeal period.
The court also ruled that the general Limitation Act's provision allowing delay to be excused does not apply here, because the special law governing bank recovery cases has its own strict, independent timeline. Additionally, the borrowers failed to give the bank advance notice of their appeal, another mandatory legal requirement they ignored.
Because of these failures, the High Court dismissed the appeal without examining its merits. This case illustrates how strict deadlines under special banking recovery laws override the more flexible general limitation rules, and how failing to meet procedural requirements can prevent a case from even being heard
