Asad Javed V. Ahmed Shah ,
CLD 2022 332 · Balochistan High Court
This case was about a civil dispute over a dishonoured cheque. Ahmed Shah (the plaintiff) claimed he had given Asad Javed (the defendant) a loan of Rs. 20,80,820 for business purposes, and in return received a crossed cheque dated 20.08.2014. When Shah tried to cash the cheque, it bounced due to insufficient funds. He sued for recovery under a special summary procedure for negotiable instruments. Javed denied taking any loan and claimed the cheque had actually been stolen by the plaintiff's brother, to whom he said he had given a much smaller amount.
The trial court sided with the plaintiff and ordered Javed to pay the amount. Javed appealed to the Balochistan High Court.
The High Court dismissed the appeal and upheld the decree. It reasoned that under Section 118 of the Negotiable Instruments Act, a cheque is presumed to have been issued for valid consideration, and the burden falls on the person denying this to prove otherwise. The court found Javed's "theft" defense self-contradictory and unsupported by evidence—he could not credibly claim the cheque was stolen while also admitting dealings involving it. Since he never proved the cheque didn't belong to his account or wasn't signed by him, mere denial was insufficient.
This judgment reinforces that cheque issuers face a strong legal presumption of liability, and vague or inconsistent defenses will not overcome that presumption.
