Taj Muhammad V. National Bank of Pakistan through Manager,
CLD 2021 791 · Balochistan High Court
This case involved a dispute between a borrower, Taj Muhammad, and the National Bank of Pakistan over an unpaid loan of Rs. 15 lakh. The Banking Court in Quetta had ruled against the borrower and ordered him to repay the bank, since he never appeared in court or contested the case. He later tried to appeal this decision to the Balochistan High Court, but filed his appeal more than a year late. He asked the court to excuse the delay under Section 5 of the Limitation Act, claiming he did not know about the judgment against him.
The High Court rejected this request. It explained that the Financial Institutions (Recovery of Finances) Ordinance, 2001, which governs bank recovery suits, is a special law that sets its own 30-day deadline for filing appeals. Under the Limitation Act's own rules, when a special law provides its own limitation period, general provisions like Section 5 (which allows delays to be excused for good reason) do not automatically apply unless the special law says so. Since the Ordinance did not allow for such exceptions, the court held it had no power to condone the delay.
The court also noted that the borrower's excuse was unconvincing, since he filed the appeal more than a month after receiving the judgment, not immediately as claimed. As a result, the appeal was dismissed as time-barred. This case clarifies that strict deadlines in special banking laws leave little room for delay in challenging court decisions.

ہائی کورٹ نے یہ درخواست مسترد کر دی۔ عدالت نے وضاحت کی کہ فنانشل انسٹی ٹیوشنز (ریکوری آف فنانسز) آرڈیننس 2001، جو بینکوں کے وص
