Muhammad Amin V. National Bank of Pakistan through Manager,

CLD 2021 553 · Balochistan High Court

This case involved a dispute between Muhammad Amin and National Bank of Pakistan over a loan recovery suit filed before a Banking Court in Balochistan. The bank had sued Amin for recovery of over Rs. 2 million. When he did not appear in court, the Banking Court declared service valid based solely on publication of notices in two local newspapers, and then passed an ex-parte judgment and decree against him without his ever presenting a defense.

Amin appealed, arguing he was never properly served and only learned of the case when the bank called him, after which he deposited Rs. 1.4 million. He said he had no real opportunity to contest the claim.

The Balochistan High Court agreed with him. It held that service through newspaper publication alone, without first attempting other standard methods like personal service through a bailiff or registered post, did not amount to valid, effective service under the relevant law. The court emphasized that procedural rules on service must be read together with the fundamental right to a fair hearing (the principle of audi alteram partem) and constitutional guarantees of due process and equal treatment under the law. The court also noted the bank had failed to submit a proper certified statement of account to support its claim, and some payments made by Amin were not accounted for.

As a result, the High Court set aside the ex-parte decree and sent the case back to the Banking Court for fresh proceedings, ensuring Amin gets a genuine chance to defend himself. The case underscores that courts cannot bypass proper notice procedures, especially in bank recovery suits where people's assets and liabilities are at
