Danish Ali and 2 others V. National Bank of Pakistan through Manager,

CLD 2021 468 · Balochistan High Court

This case involved a bank loan dispute. The National Bank of Pakistan sued three individuals to recover about Rs. 8.76 lakh they allegedly owed. The borrowers tried to defend themselves by applying for leave to defend the suit, but the trial court (Banking Court, Quetta) rejected their application because they failed to properly specify details required by law, such as the amount borrowed, payments made, and dates of payment. The trial court then ruled in the bank's favor.

The borrowers appealed to the Balochistan High Court, but they filed the appeal late, about two months after the deadline. They asked the court to excuse the delay under Section 5 of the Limitation Act, explaining that one appellant's father had died during that period.

The High Court rejected this request. It held that the Financial Institutions (Recovery of Finances) Ordinance, 2001 is a special law that sets its own 30-day deadline for appeals, and such special laws override the general Limitation Act unless they specifically allow its provisions to apply. Since the Ordinance did not permit delay condonation under Section 5, the court ruled it could not be used to excuse the late filing. The court also found that the appellants had failed to meet the legal requirements for defending the suit in the first place and had not disputed the loan or shown repayment.

The appeal was dismissed, upholding the trial court's decision in favor of the bank. This case clarifies that deadlines in special banking laws are strict and cannot be relaxed by general limitation rules.
