Messrs Amir Jan Oil Mill through Proprietor and another V. National Bank of Pakistan through Manager,

CLD 2021 25 · Balochistan High Court

This case involved a loan dispute between a bank and a borrower in Balochistan. The National Bank of Pakistan sued Amir Jan Oil Mill and its proprietor to recover Rs. 20,45,042 under a financing arrangement. When the bank filed suit, the borrowers sought permission from the Banking Court to defend the case, as required under the Financial Institutions (Recovery of Finances) Ordinance, 2001. However, their application failed to meet the specific legal requirements set out in Section 10(4) of the Ordinance, which requires defendants to clearly state details such as the amount borrowed, payments made, amounts still owed, and any specific amounts being disputed along with supporting facts.

Because the borrowers did not provide this required information, the Banking Court rejected their request to defend the case and ruled in favor of the bank. The borrowers appealed to the Balochistan High Court, arguing they should have been allowed to contest the suit.

The High Court upheld the Banking Court's decision. It found that the borrowers had partly admitted taking the loan but failed to rebut the bank's documentary evidence or show any repayment, and their appeal did not satisfy the mandatory disclosure requirements of the law. The court also noted unfavorably that the appellants failed to deposit a required surety or court fee during the appeal process.

This case illustrates how strictly courts enforce procedural requirements under banking recovery laws, meaning borrowers who wish to contest a bank's recovery suit must provide detailed, specific information, not vague
