Messrs Ghazi Rice Mills, Sole Proprietorship Ghazi Khan Lashari V. National Bank of Pakistan through Manager,

CLD 2020 574 · Balochistan High Court

This case involved a dispute between Ghazi Rice Mills and the National Bank of Pakistan over an unpaid loan. The mill had obtained financing from the bank in 2008, using its property as security, and later renewed the facility. When the mill defaulted on repayment, the bank sued for recovery of over 12.4 million rupees plus costs. The Banking Court in Quetta ruled in the bank's favor, and the mill appealed to the Balochistan High Court.

The High Court rejected the appeal on two grounds. First, under the Financial Institutions (Recovery of Finances) Ordinance, 2001, a defendant seeking permission to contest a recovery suit must specifically detail the loan amount, payments made, dates of payments, and amounts still owed. The mill's defense merely made vague denials and claimed a fire damaged its stock, without properly addressing these legal requirements, so its request to defend the case was rightly rejected by the trial court.

Second, the appeal itself was filed very late - the legal deadline was 30 days after the judgment, but the mill filed after more than 45 days beyond that deadline, offering no credible excuse. The court explained that delays can only be excused if a party shows the delay was unavoidable and not due to negligence, and every day of delay must be justified. Since the mill failed to do this, the court refused to excuse the delay and dismissed the appeal, upholding the bank's right to recover the loan.
