Yar Muhammad V. National Bank of Pakistan through Manager,

CLD 2020 362 · Balochistan High Court

This case involved a bank loan recovery dispute. Yar Muhammad had borrowed over 13 lakh rupees from National Bank of Pakistan but allegedly failed to repay it. The bank sued him in the Banking Court, which decided the case in the bank's favor and ordered him to pay the money, since he never filed an application seeking permission to contest the case, as required under the Financial Institutions (Recovery of Finances) Ordinance, 2001.

Yar Muhammad appealed to the Balochistan High Court, arguing that the bank had not properly attached required financial statements to its claim, that he was never properly notified of the case, and that his lawyer simply missed a hearing date due to being busy elsewhere, which shouldn't have cost him the chance to defend himself.

The High Court rejected these arguments. It found that notice had been properly published in newspapers as the law required, and that the bank had included all necessary documents with its claim. Crucially, the law gives a defendant only thirty days after such publication to apply for permission to defend the suit. Yar Muhammad missed this deadline by over a month, and never showed a valid reason for his absence or his lawyer's absence on the hearing date.

The High Court dismissed the appeal, upholding the lower court's decision. The judgment reinforces that borrowers must strictly follow procedural deadlines when challenging bank recovery suits, since the law is designed to ensure quick recovery of unpaid loans.
