State through Deputy Attorney General for Government of Pakistan V. Ikramullah,
CLD 2020 1203 · Balochistan High Court
This judgment concerns a copyright dispute over pirated books in Quetta. The Federal Investigation Agency (FIA) registered a case against a shopkeeper, Ikramullah, after Oxford University Press Pakistan complained that pirated copies of its books were being sold in the market. Ikramullah told FIA officials he had bought the books from another shop but could not produce purchase documents, so he was arrested and charged. The trial court later acquitted him under section 249-A of the Criminal Procedure Code, which allows a magistrate to acquit an accused at any stage if there is no likelihood of conviction. The government appealed this acquittal to the Balochistan High Court.
The High Court upheld the acquittal, but on a more fundamental ground: it found that the FIA never had jurisdiction to investigate this matter at all. The FIA was created to investigate offences connected to the Federal Government, not private commercial disputes. Since Oxford University Press is a private business and the dispute over pirated books was essentially civil in nature between private parties, the FIA had no authority to register the case. The court held that under the Intellectual Property Organization of Pakistan Act, 2012, only the specialized Intellectual Property Tribunal has exclusive jurisdiction to investigate and try such copyright offences. Using its inherent powers under section 561-A of the Criminal Procedure Code, the court converted the government's appeal into a petition to quash the FIR entirely, and did so.
This ruling matters because it clarifies that copyright and intellectual property offences

ہائی کورٹ نے بریت کو برقرار رکھا، مگر ایک زیادہ بنیادی
