Muhammad Rasool V. Abdul Ghafoor,

CLD 2014 111 · Balochistan High Court

This case involved a dispute between two men, Muhammad Rasool and Abdul Ghafoor, over a property. Ghafoor sued Rasool for damages, claiming Rasool had falsely accused him of snatching a sale agreement during an earlier property dispute, leading to an FIR being filed against him. Ghafoor was later acquitted of the criminal charge, but argued the false accusation damaged his reputation and caused him mental suffering, so he sought Rs. 20,50,000 in damages. The trial court partially agreed, awarding him Rs. 800,000.

Rasool appealed to the Balochistan High Court, arguing the trial court had wrongly relied on documents that were never properly presented or proven in court, and had not properly examined whether all the legal requirements for a "malicious prosecution" claim were met.

The High Court agreed with Rasool. It explained that to win a malicious prosecution case, a plaintiff must prove several things: that he was prosecuted by the defendant, that there was no reasonable or probable cause for the prosecution, that the defendant acted with malice, that the case ended in the plaintiff's favor, and that he suffered real damage to his liberty and reputation. The court found Ghafoor proved only that he was prosecuted and acquitted, but failed to prove malice or lack of reasonable cause. Since Rasool had genuine grounds to file the police report, the appeal was accepted, the trial court's decision was overturned, and the damages suit was dismissed.
