International Bunkering Middle East DMCC v. M.T. Tridonawati,
CLD 2012 1611 · Balochistan High Court
This case concerns a dispute over unpaid fuel supplied to a ship. The plaintiff, a fuel supplier, claimed it had provided furnace oil worth over one million US dollars to the ship M.T. Tridonawati but received only a partial payment. It sued for the remaining balance, interest, and damages, and sought to have the ship arrested to secure its claim under admiralty law, which allows lawsuits directly against a ship (an action in rem) for debts like unpaid supplies.
The complication was that the ship had been sold to a new owner before the lawsuit was filed. The court examined whether this new owner, who claimed no knowledge of the outstanding debt and had genuinely paid for the ship, could be held responsible for the previous owner's unpaid bill.
The Chief Justice ruled that since the new owner had paid real, valuable consideration for the ship, held legitimate beneficial ownership, and had no knowledge of the fuel claim, he could not be made liable unless there was evidence he was part of a fake or sham sale designed to dodge the debt. No such evidence existed here.
This decision matters because it clarifies how admiralty claims interact with genuine ship sales, protecting innocent purchasers from inheriting a previous owner's debts, while reaffirming that such protection depends on the sale being real and the buyer being unaware of any hidden claims against the vessel.
