Dad Muhammad v. Muslim Commercial Bank Ltd,
CLD 2011 785 · Balochistan High Court
This case involved two account holders, including Haji Dad Muhammad, who sued Muslim Commercial Bank for recovery of money and damages, claiming they had deposited cash and cheques into their bank accounts but the bank failed to properly credit these amounts and refused to pay them despite demands. They first filed civil suits, but withdrew them after the bank argued that only a specialized Banking Court could hear such matters under the Financial Institutions (Recovery of Finances) Ordinance, 2001. When they refiled before the Banking Court, the bank again objected, this time arguing that the depositors did not qualify as "customers" and their claims did not involve "finance" as defined under the law, so the Banking Court itself lacked jurisdiction. The Banking Court agreed and returned both cases to the plaintiffs, who then appealed to the High Court.
The High Court upheld the Banking Court's decision.
