Muhammad Shoaib v. Project Director,

CLD 2011 23 · Balochistan High Court

This case involved a student, Muhammad Shoaib, who applied for a government-run scholarship under the National ICT Scholarship Program, administered by a company (National ICT R&D Fund) controlled by the Ministry of Information Technology. Applicants had to list universities in order of preference. Shoaib listed four universities in order, met the qualifying criteria after taking the required test, and was directed by the authorities themselves to move to his second-choice university when he did not meet the first university's entrance requirements, and then to his third-choice university when he did not meet the second university's requirements either. The authorities later claimed his transfer to the third-preference university was unauthorized.

The Balochistan High Court held that the authorities' objection was unjustified, since the petitioner had simply followed the process and instructions given to him at each stage. The court also emphasized that education is a state function, and under Articles 29 and 37(c) of the Constitution, the State is required to make technical and professional education broadly available and higher education accessible on merit. It further clarified that since the Company was substantially controlled by the Federal Government (through appointment and removal powers over its directors), it fell within the scope of constitutional writ jurisdiction under Article 199.

This judgment matters because it reinforces that government-linked bodies must act fairly and consistently with their own procedures, and highlights the constitutional importance of accessible education.
