Akhtar Muhammad & Brothers v. Haji Muhammad Nabi & Brothers,
CLD 2011 1730 · Balochistan High Court
This case is about a trade mark dispute over instant juice powder products called FRUTTI and TOP JUICES. The respondent, Haji Muhammad Nabi and Brothers, claimed to be the sole distributor of these products in Pakistan and said he had applied for and been allotted trade mark registration. He sued the appellant, Akhtar Muhammad and Brothers, for importing and selling similar products, arguing this infringed his trade mark rights. The trial court agreed and issued an interim injunction stopping the appellant from launching the FRUTTI product and stopping a related party from releasing it, provided the respondent posted a security bond.
The appellant challenged this order, arguing that no actual registration certificate had ever been issued to the respondent, only an application had been processed, and that without formal registration there could be no trade mark to infringe.
The Balochistan High Court agreed with the appellant. It held that under the Trade Marks Ordinance 2001, infringement can only occur if a trade mark is actually registered, not merely applied for. Since no registration certificate existed, the respondent had no legal right to protect, meaning there was no strong case in his favor, no unfair disadvantage to him, and no risk of irreparable harm justifying an injunction. The court set aside the trial court's order and dismissed the injunction application, allowing the appeal. This matters because it clarifies that mere application for trade mark registration is not enough to claim legal protection against alleged infringement.

اپیل کنندہ نے اس حکم کو چیلنج کیا اور دلیل دی کہ مدعا عل
