Malik Jaffar and 2 others V. The State,
CLD 2011 1554 · Balochistan High Court
This case involved three applicants, Malik Jaffar Khan, Haji Abdul Hakeem, and Saleemullah, who sought bail after being arrested in a murder case registered under Pakistan's Penal Code. They were accused, along with several companions, of attacking a complainant and two others with firearms during a tribal dispute, resulting in one death and one injury.
The applicants argued they should get bail because rival cross-cases had been filed by both sides, making it unclear who was the aggressor, and because no specific individual role had been assigned to each of the many accused named in the case.
The Balochistan High Court rejected these arguments. It found that the applicants were clearly named in the initial police report, that witnesses including the complainant and the injured victim had given supporting statements, and that medical evidence confirmed the cause of death matched the allegations. The court also noted that under Section 149 of the Penal Code, when a crime is committed by an unlawful assembly of five or more people pursuing a common objective, every member can be held equally responsible—so the lack of individually specified roles did not help the applicants' case. The court also pointed out that the rival case had been filed hours after the original complaint, suggesting it was a defensive afterthought.
The court therefore refused bail, while clarifying its comments were preliminary and should not influence the trial court's independent judgment on the merits.
